Virtual Judicial System: A New Era And It’s Challenges For Bangladesh


Very recently the government has published a gazette notification for introducing virtual courts to resume normal court proceedings amid the Covid-19 lockdown in Bangladesh.

The Ministry of Justice on Saturday published the gazette notification of the ordinance namely "Usage of Information and Communications Technology in Court 2020" ordinance after the President's approval.

As the nationwide lockdown continues to prevent the spread of Covid-19 in the country, all courts in the country have been closed for almost two months. In such a situation, the people are being deprived from getting justice as many cases remaind pending and consequently huge burden and pressure on the courts are increasing day by day. 

 

Taking this into consideration, the Cabinet on Thursday approved an ordinance that allows courts to act digitally through video conferencing.

According to Section 93 (1) of the Constitution, our Hon'ble President consequently issued the Ordinance.

The ordinance states that after ensuring the virtual attendance of the groups, their lawyers and eyewitnesses through audio, video or any electronic means, any courts can serve orders, verdict, trial, investigation, appellate hearing, claims, and request for justice.

As I mentioned earlier, the COVID-19 pandemic has affected all aspects of our daily life and hence it was necessity to take such indispensable measures to ensure physical distancing in the court arena by turning the normal court procedures into virtual formats. Beyond the utility of virtual hearings as short term emergency measures, there's reason to believe that this moment can mark the beginning of a shift toward raised use of virtual hearings within the long term.

Virtual hearing manifestly brings significant benefits, but new risks must also be noted.

Principal of Open Court

The open court theory states that the public (including the media) has free and fair access to court proceedings. With its foundation of freedom of speech and freedom of expression, this doctrine allows public, reporter or party to attend court proceedings.

The Supreme Court of India has reiterated the importance of open court theory in Naresh Shridhar Mirajkar and Ors. v. State of Maharashtra and Ors, stating that Public trial in open court is undoubtedly essential for the healthy, objective and fair administration of justice. Trial command subject to the overall public scrutiny and gaze naturally acts as a check against judicial desire or vagaries and may be a sturdy instrument for making confidence of the overall public at intervals the fairness, judgment, and tendency of the administration of justice.

However, the Supreme Court of Bangladesh is now adjudicating on extremely urgent matters amidst an epidemic. There's an important requirement to enable public access to such proceedings, and therefore the lack of an equivalent is raising concerns about the longer term of virtual courts in Bangladesh.

This initiative is openly welcomed by legal fraternity, which unfortunately includes only a few specialized and technologically-conscious class lawyers, and not all brethren.

Open court theory traces its origin to 1215 Magna Carta. Particularly section 40 is relevant here, which translates-

“To no one will we sell, to no one will we refuse or delay, right or justice...”


This term envisages not only the rights of litigants to get their case resolved by Court, but also the right of the general public to attend legal proceedings. This clause has laid the inspiration stone for several subsequent constitutional provisions that articulate for open courts.

The commitment of judiciaries and legislatures across the world to guard the principles of openness of courts is expressed. 

The Supreme Court of Canada followed the same pattern in The Vancouver Sun v. Attorney General Canada, as the Supreme Court of India in Naresh Sridhar Mirajkar.

Some Other Challenges To Make Effective Virtual Court

ACCESS TO JUSTICE

Perhaps, many argue that online activities or virtual courts in general give broad access to justice due to access to the Internet. This will only be true if every person, including lawyers, judges, court staff, the media and other people in the public are given ways to participate and understand the proceedings.

I think whereas metropolitan cities like capital of Bangladesh, Chattagram, Rajshahi, Khulna etc. that have continuous access to good internet connection, the persons living there would be able to avail of virtual court services, but there's overwhelming majority of citizens who would still suffer because of lack of basic infrastructure. It's pertinent to say that there are 64 District Courts across the country that face shortage of IT infrastructure. Comprehensive development demands that all social groups have equal access to the services provided by the state.

In addition, we cannot overlook the fact that in order to make such serious technical progress, all legal officers, attorneys, and other court employees must have complete digital literacy and training, including filing and submitting files before the appropriate court. At every level, everyone involved in the legal system has a long way to go and to learn by themselves, and adjust with  a new system in a day or a week.

CONDUCT OF WITNESSES AND FALSE TESTIMONY  

There is an important distinction between audio-video and testimony in court, because the latter gives the court more opportunity to evaluate the witness through their testimony and conduct.

Physical presence can provide important expressive functions, especially during cross-examination, which ultimately leads to the discovery of truth. Evidence recorded through videoconferencing distorts nonverbal cues such as facial expressions, postures, and gestures. For example, delayed streaming may create difficulties   to detect facial responses. Even in a perfectly functioning live stream, person's face can transcend facial expressions, while gestures may be partially obscured or completely absent.

John Henry Wigmore, a fundamentalist on the law of evidence, once said that “cross–examination is the greatest legal engine ever invented for the discovery of truth”. Inadvertent cross-examination can increase the risk of error.

Another problem that arises when recording statement and conducting evidence through videoconferencing is that parties of the suit or witnesses may testify from the environment in which they are most comfortable. Such scenarios lack the required tension that comes with appearances within the Courtroom, with the ceremonies like taking the oath in physical presence of a judicial officer, lawyers court staffs. In such circumstances, there are all the probabilities that in such proceedings, the parties testifying may be happy perhaps excessively so to testify falsely.

Section 159 of the Evidence Act, 1872 allows the witness to refresh his or her memory during the examination with the permission of the court of witness. Where a witness answers questions during his cross-examination, the material placed before him defeats the whole purpose of such examination.

PRIVACY PROTECTION  

As with court records, witness testimony often contains important personal information. Although such evidence is usually seen in public court and is available in writing through court scripts, it is not easily accessible to the general public because it is broadcast online. If the virtual hearing is recorded and publicly available, the evidence is likely to be misused in new ways. For example, can the presence of a large cache of recorded virtual audits allow individuals to “mine” the hearing set and use the results for financial gain? There is no doubt that it provides protection against some form of abuse. However, identifying privacy invasions as a potential concern in the context of virtual hearing requires understanding and understanding the specific nature of these risks.

Relatedly, if witnesses are limited to the eyes and ears of those in the courtroom if their testimony is online, how can they participate in virtual court proceedings? Concerns about adverse effects on witnesses are reflected in cameras during court deliberations.

Virtual Hearings hold great promise in giving people better access to the activities of our courts. This is a good thing. However, openness is not the only variable at play. Participants ’privacy interests and moving from physical to virtual space influences participants’ experiences and treatment. Undoubtedly, additional factors also need to be weighed - for example, the gaps in the technical capabilities of some lawyers and judges, as well as inequitable public access to the Internet and virtual hearings (eg, computers, smartphones) or tablets, or hardware. In order to decide how we will proceed and what the future courts will look like, we must engage in robust analysis that embraces the full complexity of the issue.

AT THE END

No doubt that the justice system will surely benefit with the introduction of virtual courtrooms. there's little question that the necessity of the hour is to travel for a virtual set-up. By introducing such technology, during a phased and timely manner, video conferencing will surely assist within the administration of justice during the Covid-19 crisis. If implemented properly, this may certainly also increase the efficiency of the entire justice system within the country. However, the above challenges must be borne in mind and addressed before any steps are taken for virtual proceedings. Otherwise, the entire initiative may backfire. Virtual proceedings will only achieve success if the sensible situation of the litigants and therefore the overall technological infrastructure are synced during a proper manner. A virtual court isn't one window solution; rather it requires that variety of disparate individual components are carefully integrated to make a seamless operating environment. The question that must be asked is whether or not Bangladesh is prepared and, if not, how can we take steps to form it ready for such situations within the future.

After all to make the virtual court effective and fruitful, the above challenges must be handled carefully so that every citizen of Bangladesh is able to take sweet taste of new judicial system appropriately.
